Protesters Comments on the Program Office's Response to Protest
ATA FILES IN SUPPORT OF AUCTION PROTEST. In support of its formal protest of a planned FAA Auction of slots at Newark Liberty International Airport, ATA filed its response to the FAA's opposition to the protest. The protestor's comments on the Program Office's response to protests assert that FAA lacks authority to auction slots, that FAA will violate several laws if it does auction slots, including the Anti-Deficiency Act and an expense prohibition on new user fees, and that the FAA has violated the due process rights of ATA and other parties. This case is pending before the FAA Office of Dispute Resolution for Acquisitions. (September 12, 2008)
