ATA Joins Fight Against LAX Fee Increases

Los Angeles World Airports (LAWA) recently imposed unilateral rent and fee increases on airlines at LAX.  A number of airlines, including several ATA members, challenged the increases in an expedited proceeding at DOT.  ATA intervened in order to address significant policy issues this case raises.  Among other things, ATA's initial brief argues that LAWA is not a normal commercial landlord because of statutory and regulatory restrictions that apply to it and that, consequently, it may not unilaterally impose a rents that are purportedly based on the fair market value of terminal real estate.
