ATA Protests Newark Slot Auction
ATA has filed a formal protest of FAA’s planned auction of slots at Newark airport with the FAA Office of Dispute Resolution for Acquisition. The protest notes that both the issuance of the Notice of Slot Auction and the conduct of the slot auction are unlawful because the FAA lacks authority to auction slots or to expend any funds to implement a slot auction and because FAA is depriving ATA and its members of their procedural rights under the Administrative Procedure Act and the Due Process Clause of the U.S. Constitution. Several ATA members also filed individual protests. The ATA protest complements ATA’s legal challenge in the court of appeals. (8/14/2008)
