ATA filed an amicus brief supporting Alaska Airlines in a lawsuit brought by a group of non-U.S. passengers who sued for damages due to delay resulting from the pilot's decision to divert the flight. The trial court held that under the Tokyo Convention, an airline is not liable for actions taken by a pilot to preserve good order and discipline onboard an aircraft. The Tokyo Convention, which generally addresses a pilot's authority to maintain aircraft and passenger safety, is rarely invoked in litigation.
